Our Contracts – Read This Before You Download
Thank you for choosing Gold Star Adjusters. Because public adjusting is regulated at the state level, you must use the contract that matches the state where the damaged property is located (not necessarily where you live). We maintain approved agreements for Florida and Georgia, and we add or update forms as licensing expands. Always download the most current version posted here before signing.
What You’ll See in Every Gold Star Contract
All versions clearly identify Gold Star Adjusters, our license information, contact details, and the specific loss location, policyholder name(s), and type of claim (emergency, non-emergency, supplemental). Fees are contingency-based and are earned only on amounts recovered after we are retained; you’ll see the percentage written in bold before you sign, and it will never exceed the maximum allowed by applicable law.
Your Cancellation / Cooling-Off Rights
Florida: You may cancel within 10 days of signing for any reason. If the contract was signed because of a Governor-declared state of emergency, you may cancel within 30 days of the date of loss or 10 days after signing—whichever is longer. You may also cancel if we fail to provide you and your insurer a written estimate within 60 days (unless factors beyond our control apply). This statutory language appears in large bold type immediately above the signature line, as required.
Georgia: State law builds in a 3-business-day rescission right (written notice, including by email or fax, accepted). Any amounts you’ve paid must be returned within 15 business days after we receive your rescission. The law also requires an insurer-notification letter signed by you before we contact your carrier; our Georgia form complies.
Fee Caps & Special Limits (Florida)
Florida caps public adjuster compensation on residential & condo policies: 10% of payments for claims arising from a declared state of emergency (during the first year), 20% for other claims, 1% if the insurer pays full policy limits quickly, and 0% on amounts paid before you sign. Fees cannot be charged on deductibles, and additional living expenses require a separate written agreement. Your Gold Star contract reflects these rules.
Consumer Copies & Disclosure Forms
You are entitled to an unaltered copy of the executed contract at signing, and (in Florida) to a separate Claim Process Disclosure explaining the roles of company, independent, and public adjusters along with your rights to communicate directly with your insurer or attorney. Georgia requires contracts be executed in duplicate (one for you, one for us) and pre-approved by the Insurance Commissioner. We follow both states’ mandates.
We Represent the Insured—Never the Insurance Company
Gold Star Adjusters advocates exclusively for policyholders. Our Georgia contract includes the statutorily required “WE REPRESENT THE INSURED ONLY” notice; our Florida materials likewise emphasize that we work for you, not the carrier.
No Legal Services / When to Involve an Attorney
Public adjusters are not attorneys and cannot provide legal advice. If legal action becomes necessary, we will coordinate with counsel of your choice and, where appropriate, request a Letter of Protection to ensure our fee is paid from claim proceeds.
